The Homeland star is expecting a baby with the actor, but she is also embroiled in a nasty divorce battle with her estranged husband.

Austin Chick, who married the actress in 2011, filed for divorce in June (15).

Baccarin later went public with her on-set romance, and her baby news was confirmed earlier this month (Sep15).

She won custody over the former couple's son Julius, who turns two next month (Oct15), but the legal wrangling over the divorce continues.

Editors at TMZ.com have now obtained court papers filed as part of the dispute which reveal Baccarin and Ben McKenzie are planning to wed.

In the documents, the actress states, "Today, I am in a new committed relationship. I am planning to re-marry. Also, I am three and a half months pregnant."
