Michael Madsen has been charged with two counts of driving under the influence (Dui) stemming from his arrest in September (12).
The Kill Bill star's vehicle was pulled over by cops in Malibu, California after he was reportedly spotted driving erratically on the Pacific Coast Highway.
He was arrested on suspicion of Dui after a sobriety test allegedly showed his blood alcohol content to be more than double the legal limit.
His lawyer insisted the test had been "flawed" but the Los Angeles City Attorney filed two misdemeanour counts against the actor last Wednesday (05Dec12).
One charge is for driving under the influence and the other is for driving with a blood alcohol count of .08 or higher, according to Tmz.com.
The case is set to go before a judge later this month (Dec12).
