Although nearly three months have passed since Tracy Morgan was involved in a fatal car accident on June 7th on the New Jersey Turnpike, the 45 year-old comedian is reportedly still struggling to recover from the injuries he sustained.

Following the crash, Morgan remained in intensive care at Robert Wood Johnson Hospital for two weeks, and was then transported to a rehabilitation facility for a further three weeks to receive treatment after suffering a broken nose, broken ribs, and undergoing emergency surgery to repair a broken femur. But according to his attorney, Benedict P. Morelli, Morgan is "really having a tough time."

The '30 Rock' actor, who was travelling in a limo bus when a Walmart tuck crashed into it at the start of last month, barely survived the multiple car pileup, but his mentor, 63-year-old James McNair, tragically died in the accident.

Morelli recently revealed to the Star-Ledger that Morgan is currently relying on a wheelchair to move around, and it could be months before he is able to walk freely again. "He's making incremental progress," the attorney explained. "But they'll have to wait another month before they assess him cognitively."

The 'SNL' alum's eventual release from rehab came only days after he filed a lawsuit against Walmart over the tragic crash.

The man behind the wheel of the Walmart truck, Kevin Roper, 35, of Jonesboro, pleaded not guilty to one count of vehicular homicide and four counts of assault by auto, during his first court appearance at Middlesex County Superior Court in New Brunswick, New Jersey, on June 11th.

According to a criminal complaint filed by New Jersey State Police driver caused the accident by driving his truck "without having slept for a period in excess of 24 hours."

Morgan's legal papers argue that Roper fell asleep moments before impacting with their limo bus. The driver is currently out of jail on $50,000 bail, but if convicted of all charges he will face up to 15 years in prison.
