Tracy Morgan has returned home to continue his recovery, five weeks after sustaining serious injuries in a New Jersey car crash. The crash, which left him suffering broken ribs, a broken nose and a broken leg, occurred when his limo bus was rear ended by a Wal-Mart tractor-trailer. Tragically, Morgan’s longtime colleague and friend James McNair was killed in the collision.

The lawsuit, filled on Thursday (June 10th), alleges that Wal-Mart should have known that the truck’s driver, Kevin Roper, had been awake for more than 24 hours when he was said to have fallen asleep at the wheel.

The suit reads, “As a direct and proximate result of the physical injuries sustained by Mr. Morgan in the collision, he has been in capacitated from pursuing his usual employment and other activities, may be left with disabilities that will in the future similarly incapacitate him and cause him pain and suffering, and may require medical treatment.”

Morgan and his co-plaintiffs are seeking unspecified damages from the retail giant who they believe acted negligently. Roper has previously pleaded not guilty to one count of vehicular homicide and four counts of assault by auto, during his first court appearance on June 11th.

Wal-Mart have responded to the suit by issuing a statement and expressing their condolences towards those involved in the accident. "We know it will take some time to resolve all of the remaining issues as a result of the accident,” said the company. “But we're committed to doing the right thing for all involved."

Days after filling the lawsuit, Morgan was finally released from a rehabilitation centre where he had been recovery from his injuries.

A statement made by his publicist read, “Tracy has been released from the rehabilitation center and will continue his recovery efforts at home with an aggressive outpatient program.” The comedian also thanked those who had helped him get to this point, while asking for privacy during this “crucial stage” of his recovery.
