The comedian's attorney has sparked worry after admitting it is unknown if he will be "the Tracy Morgan he once was," when revealing Morgan suffered a severe brain injury in the crash.
Although it has been over five months since Tracy Morgan was involved in a fatal car accident in June, when a Walmart tuck allegedly caused a six-car pileup on the New Jersey Turnpike, which resulted in the comedian being severely injured, he is still struggling to recover.

Following the crash, Morgan remained in intensive care at Robert Wood Johnson Hospital for two weeks, and was then transported to a rehabilitation facility for a further three weeks to receive treatment after suffering a broken nose, broken ribs, and undergoing emergency surgery to repair a broken femur. However, Morgan also suffered a severe brain injury and it is unknown if he will be "the Tracy Morgan he once was," his lawyer said Tuesday (Nov 18th).

Benedict Morelli, Morgan's attorney, told reporters "Mr. Morgan is a fighter," outside the federal courthouse in Trenton, where he and Walmart's legal team met to schedule hearing dates for the 'SNL' alum's negligence lawsuit.
"He's fighting to get better, and if there's a chance for him to be back to the Tracy Morgan he once was, he's going to try to do that," Morelli said. "But we just don't know because of the severity of the injuries that he sustained and the fact that he had such a severe brain injury."

Not only Morgan, but several other individuals are suing the retailer mainly due to the apparent condition of the Walmart driver Kevin Roper, who slammed into the '30 Rock' actor's Limo bus ON June 7th, which sent them to hospital as well as killing Morgan's mentor, 63-year-old James McNair.

According to a criminal complaint filed at the time by New Jersey State Police, Roper caused the accident by driving his truck "without having slept for a period in excess of 24 hours." But Roper, 35, of Jonesboro, pleaded not guilty to one count of vehicular homicide and four counts of assault by auto.
Furthermore, Walmart filed legal papers in September that blamed Morgan as his injuries "were caused, in whole or in part, by plaintiffs' failure to properly wear an appropriate available seatbelt restraint device."
